These terms govern your access to and use of GrowthNodes products and services. Please read them carefully before using our platform.
1. Acceptance of Terms
By accessing or using GrowthNodes services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
We reserve the right to update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify you of material changes via email or through the platform.
2. Description of Services
GrowthNodes provides an AI-powered phone system and sales engagement platform, including but not limited to call recording, transcription, CRM synchronization, automated outreach, and analytics tools. The specific features available to you depend on your subscription plan.
3. Account Registration
You must provide accurate, current, and complete information during registration. You are responsible for safeguarding your account credentials and for all activities that occur under your account.
You must be at least 18 years old and have the legal authority to enter into this agreement. If you are using the services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
4. Acceptable Use
You agree to use the services only for lawful purposes and in accordance with these terms. You must comply with all applicable laws regarding call recording, including obtaining consent from all parties where required by law.
You may not use the services to transmit spam, engage in harassment, violate intellectual property rights, or attempt to gain unauthorized access to our systems or other users accounts.
5. Payment and Billing
Fees are billed in advance on a monthly or annual basis depending on your selected plan. All fees are non-refundable except as expressly stated in these terms or required by applicable law.
We may change our pricing with 30 days advance notice. Price changes will take effect at the start of your next billing cycle.
6. Data and Privacy
Your use of the services is also governed by our Privacy Policy. You retain ownership of all data you submit to the platform. By using the services, you grant us a limited license to process your data as necessary to provide and improve our services.
7. Intellectual Property
GrowthNodes and its licensors retain all rights, title, and interest in the services and all related intellectual property. These terms do not grant you any right to use GrowthNodes trademarks, logos, or branding without prior written consent.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or service interruptions caused by factors beyond our reasonable control.
9. Termination
You may cancel your account at any time through your account settings. We may suspend or terminate your access if you violate these terms or if required by law.
Upon termination, your right to use the services ceases immediately. We will retain your data for 30 days after termination, after which it will be permanently deleted unless a longer retention period is required by law.
10. Limitation of Liability
To the maximum extent permitted by law, GrowthNodes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the services.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GrowthNodes is incorporated, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved through binding arbitration.
